This Site is intended for Rehabilitation Professionals such as Physical Therapists, Occupational Therapists, PTA's, COTA's, Speech Therapists, Athletic Trainers, and MD's.

HEP2go.com's Statement of Rights and Responsibilities. By using or accessing HEP2go, you agree to the above paragraphs and the following statements.

  1. Names
    Use your name and your credentials you want to be seen on the home exercise programs as "created by". The name you list at sign up will be the name placed on the home exercise programs for your clients. The information you post also becomes public so that rehab professionals can follow each other and know who is creating great exercise content. If there is any info you wish not to be public then be sure to go to your "Account Settings" page where you can edit your info and under "Privacy" where there are further privacy options.

    Keep your password safe. This is your account. Do not share your password.

  2. Account Email - The email address used at sign up is not public at any time. We never sell or use your info or email at any time or in anyway expect as to provide you with our services and tools on this site. 

  3. Privacy/Sharing Content and Information 
    Your privacy is very important to us. You understand that the information you provide on your profile pages can be deleted or changed by you (the user) and thus if there is information you do not want public, that you can delete or change such information by simply clicking "Edit" on your profile page or go to your Account Settings page where there are more privacy options.
  4. You certify that you have company approval and authorization to administer this account for purposes of providing home exercises to patients/clients at the facility, business or organizationyou are using it for.
  5. Exercise Content Creation: Exercises created by users are controlled and maintained by the creator of the exercise. When creating photo or video exercises, you can choose to create it as "Public" or "Private". If "public" is chosen, then it may be viewable by all users that visit the site whether a member or non-member and that anyone can have access to using the exercise for themselves or others in the form of advice, education, printing, emailing and any other means with the tools on our site. These exercises can be deleted on your profile page with the link provided if needed. All images and videos uploaded must not be copyrighted, trademarked or registered data unless it is by you the member. All photos and videos uploaded are subject to being removed from site, being removed from certain pages or being changed to private if it deemed inappropriate as determined by the HEP2go Team.
    When a "private" exercise is created, then this exercise will be marked with a red   "pad-lock" and will only be viewable by the user/creator and any printed home exercise program that you may provide to your patient/client.

    All saved routines/protocols are groupings of exercises for general conditions saved in a way to easily reproduce them to use for another home program. As a Basic plan/Free member, your routines/protocols are set as private, meaning that only you can see and use them for the purposes of sending a home exercise program.

    When naming a saved routine, adding a comment or editing the text description of an exercise or education item, you agree to not use any protect health information.

  6. Content - You are the administrator of the account and control of the content and information you post on HEP2go. You have the ability to create and delete exercise(s) and routine(s) you create and you can edit your profile details and make profile details private if needed on the "Account Settings" page. In addition:

    1. For content that is covered by intellectual property rights, like photos ("IP content"), you give us the following permission: for exercises and educational items you create, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to allow other members and users of this site to use it for the purposes of building a home exercise program and send it electronically and/or print it for a patient/client.
    2. We always appreciate your feedback or other suggestions about HEP2go, but you understand that we may use them without any obligation to compensate you for them (just as you have no obligation to offer them).
    3. HEP2go has the right to completely remove your created exercise or educational item and can move any exercises into different categories on the site for any reason. Deletion may occur immediately without warning. Some reasons for removal include but is not limited to: inappropriate content, irrelevant content, copyrighted, possible copyrighten content, content with line drawings, content with product endorsements unless approved by HEP2go Inc. and any content copied from other websites or apps. Some reasons for moving exercises from public to private include but is not limited to:content with rehab company names or logos showing clearly, content with line drawings, content with blank images, content with removed images and content with very small images or dark images.
    4. For exercises you create and mark as "Public", you give us permission to displayed the exercises throughout the site on public pages with your name as the creator. This allows any member whether Free/Basic plan member or Pro to view and use the exercise for any use including printing and or emailing for patients or clients or other people in the form of an home exercise program. You have privacy options on the "Account Settings" page where you can remove your name listed as the creator if you so choose.
    5. You give us permission to use your public custom created exercises and content on HEP2go for the purposes of any users to build home exercise programs to send to recipients (patients/clients).
    6. Photos and videos used to create custom exercises used must be your original images/videos and not copyrighten from other entities. The user holds full responsibility to upload and use photos he/she has full right to use. You also agree to only use videos and photos of which each person in the image or video agrees to the use of the image/video to be in an exercise on the site for purposes of user(s) to create home exercises for other recipients. If any such person in a photo or video requests to remove the image or video, then you agree to delete the exercise/educational content.
    7. Sharing Private content: Exercises that are set as "Private" cannot be seen on the site by other members or users of the site, unless the creator has a "Pro" membership and shares it to another "Pro" member on the site. Only targeted member(s) will be able to view and use the exercise for the purposes of creating a home exercise program for a recipient (patient/client) at the discretion of the creator. If you share a routine to someone, and all the exercises on the routine are either public exercises and or private exercises you created, then the recipient will be able to load and see all exercises on it even though you did not specifically share each individual exercise to him/her. It is implied that you want to share to the recipient all the exercises in the shared routine because it contains exercises you created and or public exercises. If someone saves a new routine with someone else's private exercises on it and then tries to "Re-share" the routine to someone else, the private exercise(s) will not show when its loaded unless the recipient has sharing rights to the exercise(s).This way, the private exercise is only seen and used by specific members that the creator chooses.
    8. HEPs printed - You are responsible to print hard copies for your paper charting or save a PDF for your electronic records. We are not responsible to store the HEPs that you create.
  7. Safety
    We do our best to keep HEP2go safe, but we cannot guarantee it. We need your help to do that, which includes the following commitments:
    1. You will not send or otherwise post unauthorized commercial communications (such as spam) on HEP2go.
    2. You will not collect users' content or information, or otherwise access HEP2go, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
    3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on HEP2go.
    4. You will not upload viruses or other malicious code.
    5. You will not solicit login information or access an account belonging to someone else.
    6. You will not bully, intimidate, or harass any user.
    7. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
    8. You will not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content without appropriate age-based restrictions.
    9. You will not offer any contest, giveaway, or sweepstakes ("promotion") on HEP2go without our prior written consent. If we consent, you take full responsibility for the promotion.
    10. You will not use HEP2go to do anything unlawful, misleading, malicious, or discriminatory.
    11. You will not do anything that could disable, overburden, or impair the proper working of HEP2go, such as a denial of service attack.
    12. You will not facilitate or encourage any violations of this Statement.
    13. This Site is intended for Rehabilitation Professionals such as Physical Therapists, Occupational Therapists, PTA's, COTA's, Speech Therapists, Athletic Trainers and MD's.

  8. HEP2go users commitments:
    1. You will not use your personal profile for your own commercial gain (such as selling your status update to an advertiser).
    2. You will not use HEP2go if you are not a health or fitness professional that works in the professional field with appropriate skills to give such exercise advise to others.
    3. You will keep your contact information accurate and up-to-date if you want such info listed. Otherwise leave blank the information that you are not comfortable making public and or use the privacy control on the "Account Settings" page .
    4. You will not share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account 

  9. Protecting Other People's Rights
    We respect other people's rights, and expect you to do the same.
    1. You will not post content or take any action on HEP2go that infringes or violates someone else's rights or otherwise violates the law.
    2. We can remove any content or information you post on HEP2go if we believe that it violates this Statement.
    3. You will not use our copyrights or trademarks or any confusingly similar marks, without our written permission.
    4. You will not violate HIPPA or any other patient privacy laws in your country, state or province

  10. Technology limitations and modifications: 
    HEP2go will make reasonable efforts to keep the HEP2go Service operational. However, certain technical difficulties or maintenance may, from time to time, result in temporary interruptions. HEP2go reserves the right, periodically and at any time, to modify or discontinue, temporarily or permanently, functions and features of the HEP2go Service, with or without notice, all without liability to you for any interruption, modification, or discontinuation of the HEP2go Service or any function or feature thereof. You understand and agree that HEP2go has no obligation to maintain, support, upgrade, or update the Service, or to provide all or any specific content through the Service. 
  11. Warranty: 
    We endeavor to provide the best service we can, but you understand and agree that THE HEP2go SERVICE IS PROVIDED "AS IS", WITHOUT EXPRESS OR IMPLIED WARRANTY OR CONDITION OF ANY KIND. YOU USE THE HEP2go SERVICE AT YOUR OWN RISK. HEP2go DISCLAIMS ANY WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
  12. Amendments
    1. We can change this Statement if and when needed. Please check from time to time for updates.
  13. Termination
    If you violate the letter or spirit of this Statement, or otherwise create possible legal exposure for us, we can stop providing all or part of HEP2go to you. We will notify you by e-mail or at the next time you attempt to access your account. You may also delete your account or disable your application at any time. In all such cases, this Statement shall terminate. 
  14. Disputes
    1. You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to this Statement or HEP2go exclusively in a state or federal court.
    2. If anyone brings a claim against us related to your actions, content or information on HEP2go, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
    3. WE TRY TO KEEP HEP2go UP, BUG-FREE, AND SAFE, BUT YOU USE IT AT YOUR OWN RISK. WE ARE PROVIDING HEP2go "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HEP2go IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. IF YOU ARE A CALIFORNIA RESIDENT, YOU WAIVE CALIFORNIA CIVIL CODE §1542, WHICH SAYS: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR." WE WILL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR INCIDENTAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THIS STATEMENT OR HEP2go, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR HEP2go WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, HEP2go'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. 
  15. Special Provisions Applicable to Users Outside the United States
    We strive to create a global community with consistent standards for everyone, but we also strive to respect local laws. The following provisions apply to users outside the United States:
    1. You consent to having your personal data transferred to and processed in the United States.
    2. If you are located in a country embargoed by the United States, or are on the U.S. Treasury Department's list of Specially Designated Nationals you will not engage in commercial activities on HEP2go (such as advertising or payments). 
  16. Definitions
    1. By "HEP2go" we mean the features and services we make available, including through (a) our web site at www.HEP2go.com and any other HEP2go branded or co-branded web sites (including sub-domains); (b) our Platform; and (c) other media, software, devices, or networks now existing or later developed. Also an included domain HEPtogo.com which directs users to HEP2go.com. HEPtogo.com typed in the address bar is understood by the user to mean HEP2go.com and also follows the terms listed herein.
    2. By "us," "we" and "our" we mean HEP2go, Inc.
    3. By "content" we mean anything you post on HEP2go including exercises created, routines/protocol you create and info on your profile page.
    4. By "post" we mean post on HEP2go or otherwise make available to us (such as by creating a custom exercise).
    5. By "use" we mean use, copy, publicly perform or display, distribute, modify, translate, and create derivative works of.
    6. By "active registered user" we mean a user who has logged into HEP2go at least once in the previous 90 days
    7. By "routine" and "protocol" we mean a grouping a specific exercises saved to use at later time.
    8. By "HEP" or "HEPs" we mean a home exercise program created by adding exercises or content to the "HEP Editor" page and sent to print, SMS or email to recipient.

  17. Other
    1. This Statement makes up the entire agreement between the parties regarding HEP2go, and supersedes any prior agreements.
    2. If any portion of this Statement is found to be unenforceable, the remaining portion will remain in full force and effect.
    3. If we fail to enforce any of this Statement, it will not be considered a waiver.
    4. Any amendment to or waiver of this Statement must be made in writing and signed by us.
    5. You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.
    6. All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
    7. Nothing in this Statement shall prevent us from complying with the law.
    8. This Statement does not confer any third party beneficiary rights.
